Pending strata title at auction: what you cannot do until it issues
The line on a notice that turns a purchase into a wait.
Published 3 September 2026 · Figures as of 4 September 2026
8 of the 2,201 auctions live in this snapshot state, in the tenure line of the notice, that the strata or individual title has not yet been issued. A small number, and a disproportionate share of the questions the site's readers ask, because the phrase changes what is being sold.
With a title, you buy the registered parcel and the register records you as its proprietor. Without one, you buy the developer's contractual promise of a parcel — the rights under the sale and purchase agreement, assigned onward — and the register does not know you exist until the title issues. Everything downstream follows from that.
Why a title is missing
Strata titles are issued by the land office after the developer applies for subdivision of the parent building, which happens after completion and often years after. Individual titles on landed schemes lag for the same reason. In the interval, every unit sits on the developer's master title, and every transaction in it is an assignment of the purchaser's rights rather than a transfer of land.
That is also why these properties reach auction by the bank lane rather than the court's: with no title to charge, the lender took a deed of assignment, and enforces it under the loan agreement cum assignment — the LACA route — through a licensed auctioneer. The notice says so, and the terms are the bank's own, not the court's uniform 10% and 120 days.
What you cannot do until it issues
Register yourself. There is nothing to register on. Your interest is protected by the assignment and, in practice, by the developer's records and the bank's, until the strata title arrives and a transfer can be perfected in your name.
Borrow on ordinary terms. Banks lend against assigned rights, but not all banks and not on all terms; some lend only where the developer's master title is unencumbered and the developer is solvent. A purchaser who assumed a standard housing loan finds a shorter list of lenders and a longer approval.
Sell cleanly. Reselling before the title issues means assigning the assignment — a further layer of paperwork, a further developer's consent, and a buyer who inherits the same wait. Resale markets for untitled units are thinner and slower.
Know the developer is fine. The master title is the developer's. A developer in liquidation, or one that has charged the master title to its own lender, can leave purchasers waiting on a title that turns on someone else's insolvency. The notice will not tell you; a company search will.
Reading the notice
The tenure line usually carries it: "99 years leasehold, pending issuance of strata title", or "pending strata title". The site shows the tenure line as stated and, where the phrase appears, does not compute years remaining or treat the property as titled.
Where the notice is a bank (LACA) notice, its conditions of sale govern the deposit, the balance period and the assignment mechanics; read them rather than assuming the court terms.
Before you bid
- Find out how far the title is from issuing. The developer or the management corporation knows whether subdivision has been applied for and whether the land office has responded. "Soon" is not an answer.
- Confirm a lender will lend on an assignment, in writing, before the deposit — and that the balance period on the notice is achievable with that lender.
- Search the developer. A company search costs little and answers the question that decides whether the title ever issues.
- Price the wait. A unit you cannot sell cleanly for an unknown period is worth less than the same unit with a title, and the reserve usually reflects that. Make sure your bid does too.
FAQ
Is it safe to buy an auction property whose strata title has not been issued?
It can be, with a solvent developer, a subdivision already applied for, and a lender confirmed in advance. The risk is in the wait and in the developer, not in the auction itself.
Can I get a loan if the title has not been issued?
Some lenders lend against the assigned rights, on their own terms; others do not. Confirm in writing before you bid, because the balance period on the notice does not extend while you look.

8 of 2,201 live in this snapshot state a pending title in the tenure line. Others may be untitled without the notice saying so; the title number on the notice, or its absence, is the check.
